1. Role of Portvill.com

1.1. Portvill.com acts solely as an intermediary online platform connecting Users (Guests) with Property Owners, Hosts, or Hotel Managers (collectively referred to as «Hosts»). When you make a booking through our platform, you enter into direct, legally binding contractual relations exclusively with the Host.

1.2. Portvill.com is not a party to this rental agreement. We do not own, manage, rent out, or control the properties listed on the website. We act only as an intermediary in the transaction and are not responsible for the actual provision of accommodation.

2. Booking Cancellation and Refunds

2.1. Host's cancellation rules: Each property has its own specific cancellation and refund policies determined exclusively by the Host. By making a booking, you expressly agree to comply with the Host's specific cancellation and no-show policies with which you were acquainted during booking.

2.2. Refund processing: Portvill.com does not collect, hold, process, or issue refunds. All financial transactions related to your stay, including any applicable refunds in case of cancellations, modifications, or disputes, are handled directly by the Host or their appointed third-party payment operator.

2.3. Platform's lack of liability: Portvill.com is not liable, financially or otherwise, for the Host's failure or refusal to issue a refund, even if such a refund is due in accordance with the Host's cancellation policies. Any disputes regarding payments, deposits, or refunds must be resolved exclusively between the Guest and the Host.

3. Limitation of Liability and Disclaimer of Warranties

3.1. While Portvill.com strives to ensure the accuracy of all property listings, the information (including descriptions, prices, photos, and availability) is provided directly by the Hosts.

3.2. To the fullest extent permitted by law, Portvill.com is not responsible for:

• Any discrepancies between the description of the property on the platform and its actual condition upon arrival.
• Overbooking, refusal of entry, or unexpected cancellations initiated by the Host.
• Any injuries, illnesses, loss of property, or personal damage suffered by the Guest during their stay.
• Any fraudulent actions or misrepresentations by the Host.

4. User Content and Reviews

4.1. Content usage license: Guests may leave reviews, ratings, and photos related to their stay. Hosts may upload property descriptions, photos, and other materials. By uploading, submitting, or posting any content on Portvill.com, you grant us a worldwide, non-exclusive, royalty-free, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media formats and channels for the purpose of operating, improving, and promoting our platform.

4.2. User responsibility and warranties: You are solely responsible for all content you upload. By submitting content, you represent and warrant that:

• You own the content or have necessary licenses, rights, and permissions to publish it and grant the above license.
• The content does not infringe on intellectual property rights, privacy rights, or any other lawful rights of third parties.
• The content is accurate, not misleading, and relates to the actual booking experience (for Guest reviews) or accurately represents the real property (for Host listings).

4.3. Prohibited content and moderation: Portvill.com acts strictly as a passive conduit for user content distribution and assumes no obligation to verify its accuracy or legality. Nonetheless, we reserve the right (but not the obligation) to review, reject posting, hide, or permanently remove any content at our sole discretion without prior notice if we determine it:

• Is fake, fraudulent, or violates these Terms of Use.
• Contains illegal, offensive, defamatory, threatening, or obscene material.
• Includes personal contact information, spam, or unwanted advertising materials.

4.4. Portvill.com is not responsible for any claims, damages, or losses resulting from user content, including, but not limited to, reliance on the accuracy of property photos or opinions expressed in guest reviews.

5. Intellectual Property Terms

5.1. All rights, title, and interests in and to the Portvill.com website, its underlying software, design, logos, and aggregated database are the exclusive property of Portvill.com.

5.2. Users are not permitted to reproduce, copy, scrape data, sell, or use any part of the Portvill.com platform for commercial purposes without our prior written consent.

6. Force Majeure

6.1. Neither party is liable for any delays or failure to perform any part of this Agreement due to events beyond their reasonable control, including but not limited to natural disasters, government actions, war, terrorist acts, strikes, or major internet outages.

7. Final Provisions

7.1. Portvill.com reserves the right to unilaterally modify these Terms of Use at any time. Changes take effect immediately upon publication on the website. Users are expected to regularly check this page for updates.

7.2. The invalidity of one or more provisions of this Agreement, as determined by a final court decision, does not invalidate the Agreement as a whole.

7.3. These Terms of Use are drafted in English. Although translations may be provided for your convenience, the legally binding and authoritative document is the English version. In case of any discrepancies, ambiguities, or contradictions between the English version and any translated text, the English version prevails.
