Welcome to Portvill.com! This User Agreement (hereinafter referred to as the "Agreement") constitutes a legally binding contract between you (the "User" or "Guest") and Portvill.com. By registering an account, accessing, or using our website and services, you acknowledge that you have read, understood, and agree to be bound by this Agreement, which incorporates the core principles of our Terms of Use and Privacy Policy.

WARNING: DO NOT USE OUR PLATFORM IF YOU:

• Have not read or fully understood the terms of this Agreement;

• Do not agree with the terms of this Agreement;

• Are under 18 years of age;

• Do not have the authority to act on behalf of the person or organization whose data you provide when registering or booking.

1. The Role of Portvill.com

1.1. Intermediary Status: Portvill.com acts strictly as an online intermediary platform that connects Users (Guests) with Property Owners, Hosts, or Hotel Managers ("Hosts").
1.2. No Rental Contract with Portvill.com: We do not own, manage, rent out, or control the properties listed. When you make a booking, you enter into a direct, legally binding contract exclusively with the Host. We are not responsible for the actual provision of accommodation.

2. Account Registration and Personal Data

2.1. Data Collection: To facilitate your bookings, we collect basic contact information during registration, such as your full name, email address, phone number, and booking details.
2.2. Prohibited Data: Portvill.com strictly does not request, process, or store copies of sensitive government-issued identification (e.g., passports, national ID cards). If a Host requires these for check-in, they will request them directly from you outside our platform.
2.3. Data Security: We implement comprehensive security measures to ensure the confidentiality of your data, including appointing responsible personnel and monitoring current security threats.

3. Bookings, Cancellations, and Financial Transactions

3.1. Host Policies: Each property has specific cancellation and refund policies determined exclusively by the Host. By booking, you agree to comply with these specific rules.
3.2. Payment Processing: Your payment details are processed securely by compliant third-party payment gateways (e.g., Stripe, Paddle, PayPal, BTCPay). Portvill.com does not process, hold, or store your full credit card numbers, bank account details, or cryptocurrency private keys.
3.3. Refunds and Disputes: Portvill.com does not collect or issue refunds. All financial transactions and refund disputes must be resolved directly between you and the Host or their payment operator. Portvill.com bears no financial liability for a Host's refusal to issue a refund.

4. Data Sharing and Privacy Rights

4.1. Sharing with Hosts: We automatically share strictly necessary information (name, phone number, email, and booking dates) with the respective Host to perform your booking contract. Once transferred, Hosts act as independent data controllers.
4.2. Third-Party Services: We may share data with service providers (IT, cloud hosting) or legal authorities as required by law (including GDPR and KVKK). We also use tracking technologies (Cookies, Google Analytics, etc.) to improve our platform.
4.3. Your Rights: You have the right to request access to, clarification, blocking, or destruction of your personal data. You may withdraw your consent for data processing or opt-out of marketing communications at any time by contacting us at [email protected] or using the functions in your account.

5. User Content and Reviews

5.1. Content License: By uploading reviews, ratings, or photos, you grant Portvill.com a worldwide, non-exclusive, royalty-free, irrevocable license to use, reproduce, publish, and display such content to operate and promote the platform.
5.2. User Responsibility: You warrant that you own the rights to the content you post, that it does not infringe on third-party rights, and that it is accurate and not misleading.
5.3. Moderation: We reserve the right to review, hide, or permanently remove any content that is fraudulent, illegal, offensive, defamatory, or contains spam/personal contact information without prior notice.

6. Limitation of Liability & Disclaimers

To the fullest extent permitted by law, Portvill.com is not responsible for:

• Discrepancies between a property's listing description/photos and its actual condition.

• Overbooking, unexpected cancellations, or refusal of entry by the Host.

• Injuries, illnesses, property loss, or personal damage suffered during your stay.

• Fraudulent actions or misrepresentations by the Host or other users.

7. Intellectual Property

All rights, title, and interest in the Portvill.com website, software, design, logos, and database are the exclusive property of Portvill.com. Users may not copy, scrape, sell, or use any part of the platform for commercial purposes without prior written consent.

8. General Provisions

8.1. Force Majeure: Neither party is liable for delays or failures to perform due to events beyond reasonable control (e.g., natural disasters, war, major internet outages).
8.2. Modifications: We reserve the right to unilaterally modify this Agreement at any time. Changes take effect immediately upon publication.
8.3. Language: This Agreement is drafted in English. While translations may be provided for convenience, the English version shall be the legally binding and controlling document in the event of any discrepancy.
8.4. Severability: If any provision of this Agreement is deemed invalid by a court, the remaining provisions will continue in full force and effect.
